- ELIGIBILITY: The Invitation to Paradise Sweepstakes (the "Sweepstakes") is open only to individuals who: (a) are legal residents of the fifty (50) United States or the District of Columbia; (b) are eighteen (18) years of age or older at the time of entry; and (c) have a wedding date between July 1, 2003 and June 15, 2004. Employees of WeddingChannel.com, Inc., Taylor Corporation, Coyaba Beach Resort & Club, Air Jamaica and related companies, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Sweepstakes is subject to all federal, state, and local laws and regulations and is void in Puerto Rico and where prohibited by law.
- SPONSOR: The Sweepstakes is sponsored by WeddingChannel.com, 888 South Figueroa Street, Suite 700, Los Angeles, CA 90017 ("Sponsor").
- AGREEMENT TO OFFICIAL RULES: Participation in the Sweepstakes constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein in a timely manner.
- ENTRY PERIOD: The Sweepstakes begins on June 13, 2003 at 12:00:01 p.m. Pacific Time ("PT") on and ends on September 5, 2003 at 12:00:59 p.m. PT (the "Entry Period"). Entries received prior to or after the Entry Period will be disqualified.
- ENTRY: To enter the Sweepstakes, visit www.WeddingChannel.com, click on an advertisement for the Sweepstakes, and fill out an online entry form. Once you submit the entry form, you will receive one (1) entry into the Sweepstakes. Limit of one (1) entry per person. Subsequent entries will be void. Any entries attempted through the use of agencies or robotic, repetitive, automatic, programmed, or similar methods will be void.
- DRAWING: On or about September 10, 2003, the Sponsor will select the name of one (1) potential winner in a random drawing of all entries received. The Sponsor's decision is final. Odds of winning depend on the number of eligible entries received. The Sponsor will attempt to notify the potential winner within ten (10) days of the drawing. If the potential winner cannot be contacted within ten (10) days after the first attempt to contact him/her, the Sponsor will select an alternate potential winner in his/her place at random from all entries received.
- REQUIREMENTS OF THE POTENTIAL WINNER: Except where prohibited, potential winner will be required to complete and return an affidavit of eligibility and liability/publicity release (the "Affidavit/Release") within fourteen (14) days of being notified. If a potential winner fails to sign and return the Affidavit/Release within the required time period, an alternate entrant may be selected in his/her place in a random drawing of all entries received.
- PRIZE: One (1) winner will receive a 7-day/6-night trip for two (2) to Montego Bay, Jamaica. Prize includes two (2) round-trip, First Class airline tickets from any of Air Jamaica's gateway cities in the United States to Montego Bay, Jamaica, accommodations in an Ocean Junior Suite at the Coyaba Beach Resort & Club, two (2) meals a day, and round-trip hotel/airport transfers in Jamaica. All expenses and costs not expressly listed above including, but not limited to transportation to an Air Jamaica gateway city, airline taxes and/or service charges, Jamaican departure tax and security charges, US government departure fees and taxes, alcoholic beverages, transportation on-island (except as otherwise noted above), telephone calls, souvenirs, gratuities, and taxes are solely the winner's responsibility. The winner's guest may be required to sign a liability/publicity release before travel. The trip must be completed by June 30, 2004. Airline and hotel accommodations are subject to space availability and blackout dates and some restrictions may apply. Winner and guest must travel together and are responsible for obtaining necessary travel documents. Prize is nontransferable and non-refundable and must be accepted as awarded. The airline tickets are not transferable once issued and cannot be changed in any way. No cash or other substitution may be made, except by Sponsor, who reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason as determined by the Sponsor in its sole discretion. Trip may not be combined with any other offer. Approximate Retail Value: up to $6,660, depending on the exact itinerary.
- GENERAL CONDITIONS: The Sponsor reserves the right to cancel, suspend, and/or modify the Sweepstakes if any fraud, computer virus or other technical problem corrupts the administration, security, or proper play of the Sweepstakes, as determined by the Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes at random from among the eligible entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to any online entry, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address.
- PRIVACY: All information submitted by entrants as part of this Sweepstakes will be treated in accordance with Sponsor's Privacy Policy, which is accessible from www.WeddingChannel.com.
- RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Sweepstakes, entrants agree to release and hold harmless the Sponsor, its respective officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Sweepstakes or the processing of entries; or (e) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt of any prize. Entrant further agrees that in any cause of action, the Sponsor's liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall Sponsor be liable for attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
- DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than State of California.
- SWEEPSTAKES RESULTS AND OFFICIAL RULES: You can obtain Sweepstakes results and a copy of these Official Rules by sending a self-addressed, stamped envelope to The Invitation to Paradise Sweepstakes, c/o WeddingChannel.com, 888 South Figueroa St., Suite 700, Los Angeles, CA 90017. All requests must be received by October 30, 2003. Vermont residents may omit return postage for Official Rules requests.
